Refusal to hear the cassation appeal concerning the Court of Appeal in Warsaw judgement of legal proceedings on the compensation related to cover stranded costs of the Pątnów Power Plant II for the year 2008

Zespół Elektrowni "Pątnów-Adamów-Konin" S.A. (“Company”), in reference to the current report No. 16/2014, 38/2014 and the information concerning the legal proceedings on compensation of stranded costs of Elektrownia Pątnów II Sp. z o.o. (a subsidiary of the Company hereinafter referred to as “Elektrownia Pątnów II”) for 2008, contained in the periodical financial reports, informs that on 24 February 2016 the Company was informed that the Supreme Court refused to hear the cassation appeal concerning the Court of Appeal in Warsaw judgement of legal proceedings on the compensation related to cover stranded costs of the Elektrownia Pątnów II for the year 2008. Supreme Court ruling ends the proceedings concerning compensation for stranded costs of Elektrownia Pątnów II in 2008.
The Court of Appeal in Warsaw judgement as of 4 November 2014 is valid and enforceable by Elektrownia Pątnów II. According to arrangements, of which the Company informed in current report no. 38/2014, made between Elektrownia Pątnów II and Zarządca Rozliczeń S.A., the amount which is at issue is gradually repaid to Zarządca Rozliczeń S.A. in accordance with the agreed payment schedule.
