The judgments of the Regional Administrative Court in Poznań on the proceedings of returning the overpaid excise tax.

Contents of the report:

Zespół Elektrowni "Pątnów-Adamów-Konin" S.A. („Company”), in reference to the information contained in the extended consolidated periodical report for the III quarter of 2015 concerning the legal proceedings on excise duty refund, informs that on 18 November 2015 Regional Administrative Court in Poznań announced a judgements in 22 proceedings for the period January 2006 – November 2007, excluding November 2006 concerning the Company and judgement in proceeding for the period from December 2007 to February 2009 concerning Elektrownia Pątnów II Sp. z o.o. (subsidiary of the Company) („EPII”). In announced judgements Regional Administrative Court in Poznań W ogłoszonych wyrokach Wojewódzki Sąd Administracyjny w Poznaniu dismissed the complaint on the decisions of the Director of the Customs Chamber in Poznan refused to declare the excise tax overpayment made by the Company and EPII in the above mentioned cases (a more detailed description of these matters is included in the consolidated financial statements of the Company for the third quarter 2015 page 51). Agregated value of the overpayment claim for matters relating to the Company amounts to PLN 64.7 million (the amount reduced as a result of the economic analysis with the original amount of PLN 386 million), and cases concerning EPII amounts to PLN 42.5 million.

 

After carefully reading the written reasons for judgment issued by the Regional Administrative Court in Poznań, the Company will consider the possibility of issuing an appeal to the Supreme Administrative Court.
