Decision of the Minister of the Environment on confirmation of contested decision on refusal to state invalidity of the licence concerning the Tomisławice open pit

Contents of the report:
With reference to the current report no. 22/2013, 4/2014 and 7/2014 informing on proceedings related to the licence of the Minister of the Environment concerning the Tomisławice open pit, Zespół Elektrowni "Pątnów-Adamów-Konin" S.A. ("the Company") informs that on 8 July 2014 the Company became aware of confirmation by the Minister of the Environment of contested decision on refusal to state invalidity the licence of the Minister of Environment of 6 February 2008 no. 2/2008 granted for PAK Kopalnia Węgla Brunatnego Konin SA, for mining of brown coal and minerals for Tomisławice deposit.
In the substantiation of the issued decision, the Minister of the Environment stated that the arguments raised by the appellants in the application for stating invalidity cannot lead to the statement on invalidity of licence no. 2/2008. The Minister of the Environment pointed out that the concessive body cannot be accused of breaching the provisions of material law or civil law that could justify different settlement of the case. In the substantiation it was emphasized that in this case there are also no other premises for stating invalidity.
The decision is final. The party dissatisfied with the concerned decision shall be entitled to apply via Minister of the Environment to Regional Administrative Court in Warsaw with the complaint, within 30 days from the date of receipt of the decision.
