Decision of the Minister of the Environment on refusal to state invalidity of the licence concerning the Tomisławice open pit

Contents of the report:

With reference to the current report no. 22/2013, informing on initiating the proceedings related to the licence of the Minister of the Environment concerning the Tomisławice open pit, Zespół Elektrowni "Pątnów-Adamów-Konin" S.A. ("the Company") informs that on 29 January 2014 the Company became aware of issuance by the Minister of the Environment of a refusal to state invalidity the licence of the Minister of Environment of 6 February 2008 no. 2/2008 granted for PAK Kopalnia Węgla Brunatnego Konin SA, for mining of brown coal and minerals for Tomisławice deposit.

 

In the substantiation of the issued decision, the Minister of the Environment stated that the arguments raised by the appellants in the application for stating invalidity cannot lead to the statement on invalidity of licence no. 2/2008. The Minister of the Environment pointed out that the concessive body cannot be accused of breaching the provisions of material law or civil law that could justify different settlement of the case. In the substantiation it was emphasized that in this case there are also no other premises for stating invalidity.

 

The party dissatisfied with the concerned decision shall be entitled to apply to the Minister of the Environment for re-examination of the case, within 14 days from the date of receipt of the decision.
