Legal basis:

Art. 17 sec. 1 MAR – inside information

Content of the report:

The Management Board of ZE PAK SA (“Company”) hereby announces that on February 12, 2026, an indirect subsidiary of the Company, PAK CCGT sp. z o.o. (“PAK CCGT”) and DUON Dystrybucja sp. z o.o. (“DUON”) (together the “Parties”), entered into an agreement ensuring the supply of gaseous fuel to the combined cycle gas turbine (CCGT) unit located in Turek (“CCGT Unit”). The Agreement was concluded based on the international EFET standard (“Agreement”).

The Agreement is concluded for a period of five (5) years. After this period, the Agreement will be automatically extended for another five-year period, unless either Party submits a written notice of termination to the other Party no later than twelve (12) months prior to its termination.

The Agreement does not stipulate any minimum gas offtake volumes on the PAK CCGT side, nor does it include any "take or pay" clauses. Gas deliveries will be made to the physical exit point from the transmission system managed by Gaz-System SA ("TSO").

Settlement between the Parties under the Agreement will be based on the gas market indices of the Polish Power Exchange (TGE), i.e., the TGEgasID index (intraday gas market) and the TGEgasDA index (day-ahead gas market).

The conclusion of this Agreement represents another significant step in the Company's strategic project, which is the planned launch of the aforementioned CCGT Unit in the third quarter of 2027.
