Contents of the report:
With reference to current reports No. 16/2021 of June 4, 2021, 12/2021 of April 9, 2021 and 13/2023 of May 24, 2023, ZE PAK Spółka Akcyjna ("Company") informs that on December 21, 2023, it received information that the Supreme Administrative Court ("SAC"), at a closed session held on December 12, 2023, issued a Decision, ref. no. III OZ 609/23, in which SAC confirmed that the application of the Greenpeace Polska Foundation to suspend the execution the contested decision in the case of a complaint by the Greenpeace Polska Foundation based in Warsaw against the decision of the Minister of Climate and Environment of November 21, 2022, reference number: DIŚ-III.435.12.2020.AŻ.1. Reference number: IV SA/Wa 166/23 had no justified legal basis.
The decision of the Supreme Administrative Court confirms that the Company may still operate the 474 MW power unit with the exceptions indicated above.
